Skylink customer terms

Seller: Skylink PTY LTD, ABN 13 676 029 539, Perth, Western Australia. Website: https://www.skylinkaustralia.com. Support: [email protected].

Effective date: 22 March 2024. These terms govern Skylink software licences and the hosted account service. Governing law is Western Australia.

Skylink Security is licensed for installation on a customer-controlled recorder. The free edition allows one enabled physical camera and displays a viewer overlay. Original recordings and exports do not contain a Skylink watermark. All prices are in Australian dollars; where GST applies it is included in the price shown.

An annual NVR licence costs A$99 per year and covers one transferable installation. A lifetime NVR licence costs A$299 once, includes software updates, and supports indefinite offline local operation after initial activation. Transfer requires releasing the previous installation. An indefinitely offline copy cannot be immediately disabled following transfer; customers must discontinue its use.

Annual renewal is managed through the billing account. Existing configured cameras continue recording if the annual entitlement expires; viewing saved footage and export remain available. Adding or replacing cameras beyond the free allowance requires renewal. Online verification normally runs daily; signed annual licences allow up to 30 days offline. Connectivity failures must not stop existing recording.

Skylink Mobile is a separate A$15/year base-price subscription, purchased through Apple or Google at the localized price shown by that store. It follows one Skylink account across supported iOS and Android devices. It renews automatically unless canceled through the original store. Confirmed expiry after store billing grace returns mobile access to one selected camera. Temporary verification failures preserve an existing valid signed offline entitlement.

Customers control their cameras, network access, recordings, retention, local accounts, backups and physical storage. Hosted accounts and push delivery do not store camera footage. Skylink is not an emergency-response or guaranteed alarm monitoring service. Document supported hardware and keep recoverable backups.

Consumer rights and refunds

Nothing in these terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded.

If the software or a hosted service fails to meet a consumer guarantee, you are entitled to a remedy, which may include a refund or replacement for a major failure. Duplicate charges and charges made without authorisation are refunded. Change-of-mind refunds are not required by law and are not offered once a licence has been activated.

Apple and Google subscriptions are refunded through the store that processed the purchase, subject to that store's policy. Cancelling a subscription stops renewal; it does not by itself refund the current term.

Support

Support is provided by email at [email protected] during Australian business days on a reasonable-effort basis. Support covers installation, activation, recording, playback and account issues. It does not extend to customer network, camera hardware, storage hardware or third-party VPN configuration, although the documentation covers common configurations.

Hosted service availability

Accounts, licence verification and push delivery are hosted services. The recorder continues to record, verify a signed annual entitlement offline for up to 30 days, and operate a lifetime licence offline indefinitely if the hosted service is unavailable. Hosted push notifications are not delivered during an outage. Skylink will give at least 90 days' notice before discontinuing a hosted service. Lifetime licences continue to operate offline.

Warranty and liability

The software is supplied with the consumer guarantees that apply by law. Subject to those guarantees and to any liability that cannot lawfully be limited, Skylink's total liability arising from a licence is limited to the amount you paid for it, and Skylink is not liable for indirect or consequential loss. Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited.

Acceptable use

You must not use Skylink to conduct unlawful surveillance or to infringe another person's privacy, and you must comply with the laws that apply where your cameras are installed. You must not resell, sublicense or publish activation codes, or circumvent licence verification. Skylink may suspend hosted services for unlawful use or attempted fraud, without affecting local recording or access to your own footage.

Governing law and disputes

These terms are governed by the laws of Western Australia. You and Skylink submit to the non-exclusive jurisdiction of the courts of Western Australia. Before starting proceedings, contact [email protected] so the issue can be resolved directly. Nothing here prevents you from exercising a consumer right or from complaining to a regulator.

Third-party software terms and required notices or source offers accompany distributed components; commercial model rights do not replace those obligations.
